These Terms of Service (“Terms”) govern your access to the KXLE website and your purchase or use of products and services offered by HK Unovig Limited (“KXLE”, “we”, “us” or “our”). By using the website or placing an order, you agree to these Terms.

1. Eligibility and Acceptable Use

You must be legally capable of entering into a binding agreement in your jurisdiction. You agree to use the website only for lawful purposes and not to interfere with its security, operation or other users.

You must not misuse the website, introduce malicious code, attempt unauthorised access, scrape content through automated means without permission, impersonate another person or use the website to violate applicable law.

2. Product Information

We aim to present product descriptions, specifications, photographs and availability accurately. Screen settings, production updates and normal manufacturing tolerances may cause minor variations. We may correct errors, update information or discontinue a product without prior notice.

Unless expressly stated otherwise, website content is provided for general product information and does not constitute medical advice.

3. Important Product Notice

KXLE household oxygen generators, including the RS053, are intended for household and personal oxygen production. They are not medical devices and are not intended for emergency treatment, surgery, life support or life extension.

Consult a qualified healthcare professional before beginning or changing oxygen use, particularly if you have a diagnosed medical condition or have been prescribed oxygen therapy. Always follow the user manual, safety warnings and professional advice. Maintain an appropriate backup oxygen source when uninterrupted oxygen is medically necessary.

4. Oxygen Safety

Oxygen supports combustion. Smoking, flames, sparks, oils and grease must be kept away from the product, tubing and oxygen-enriched environments. Operate the product in a well-ventilated indoor area, maintain the required clearance around air inlets and outlets, and do not place it on soft surfaces that may block ventilation.

5. Orders and Contract Formation

Submitting an order is an offer to purchase. We may accept or decline an order for reasons including product availability, payment verification, suspected fraud, shipping restrictions, pricing error or legal requirements. A contract is formed when we confirm acceptance or dispatch the product, as determined by applicable law.

6. Prices, Payment and Taxes

Prices are displayed in the currency indicated on the website and may change without notice. Applicable shipping charges and taxes are shown at checkout where possible. International customers may be responsible for additional duties, taxes, customs and brokerage fees.

You represent that you are authorised to use the selected payment method. We may use third-party payment processors and fraud-prevention services.

7. Shipping, Risk and Delivery

Shipping is governed by our Shipping Policy. Delivery dates are estimates. Risk of loss and legal title pass according to applicable law and the agreed delivery terms. You are responsible for providing an accurate, accessible delivery address and inspecting the shipment after receipt.

8. Returns, Refunds and Warranty

Returns and refunds are governed by our Returns & Refunds Policy. Eligible KXLE oxygen concentrators include a 12-month limited warranty from the date of sale, subject to the conditions supplied with the product.

The warranty does not cover ordinary wear, consumables, accidents, misuse, incorrect voltage, blocked ventilation, liquid damage, unauthorised modifications or repairs, or use contrary to the manual. Your statutory consumer rights remain unaffected.

9. Accounts and Communications

If the website allows accounts, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you suspect unauthorised use.

You agree that we may send electronic communications relating to orders, delivery, safety, warranty, support and these Terms. Promotional communications are subject to your preferences and applicable law.

10. Reviews and User Content

If you submit a review, photograph or other content, you confirm that it is accurate, lawful and does not infringe another person’s rights. You grant KXLE a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display that content for operating and promoting our business, subject to applicable privacy law.

We may remove content that is unlawful, misleading, abusive, irrelevant or violates these Terms.

11. Intellectual Property

The website, KXLE name and logo, product imagery, text, graphics, layout, software and other content are owned by or licensed to KXLE and are protected by intellectual-property laws. Except as permitted by law, you may not copy, reproduce, modify, distribute or commercially exploit them without written permission.

12. Third-Party Services and Links

The website may use or link to third-party services, including payment, delivery and social-media services. KXLE does not control and is not responsible for third-party content, availability or practices. Your use of those services may be subject to separate terms.

13. Disclaimers

To the maximum extent permitted by law, the website is provided on an “as available” basis. We do not promise that the website will always be uninterrupted, error-free or free from harmful components. Product warranties are limited to those expressly provided with the product or required by law.

Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, KXLE will not be liable for indirect, incidental, special or consequential losses arising from website use or product purchase. Where liability may lawfully be limited, KXLE’s aggregate liability concerning a product will not exceed the amount paid for that product.

This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited under applicable law.

15. Indemnity

To the extent permitted by law, you agree to indemnify KXLE against third-party claims and reasonable costs resulting from your unlawful misuse of the website, violation of these Terms or infringement of another person’s rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Courts with jurisdiction under applicable law may hear disputes. If mandatory consumer law gives you the right to bring a claim in another location, that right is not affected.

17. Changes to These Terms

We may update these Terms to reflect changes in our business, website or applicable law. The current version will be posted here with its effective date. Changes do not retroactively alter orders already accepted unless required by law or agreed with you.

If part of these Terms is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign our rights in connection with a business transfer where permitted by law.
